Town Hall
Planning Commission Work Meeting Summary
The staff offered to the Planning Commission new language that would be added between Ordinances 10-21-8 and 10-21-9. The new paragraph would clarify conditions under which a noncomplying residence may be rehabilitated and what forms and extent of reconstruction the town will allow. The staff presented the proposed language in the format of five bullet points.
The commission members modified bullet point #1 to make clear that the town will not approve improvements to a deteriorated structure if a request to the planning commission has not preceded demolition.
The commission also changed bullets #4 and #5 to allow reconfiguration of the floor slab if it will bring the structure into better compliance with current code and to allow replacement of faulty footings.
The staff also presented the second (and last) item on the commissions agenda: a revision of the language in ordinance 10-21-11 which addresses noncomplying commercial buildings. The suggested changes were given letters A. through I.
Commission members want alteration in “A” to state that extensions are permitted if allowed in other sections of the code. “C.” should state that the town will allow an additional 2 feet in the height of restructured building only if an engineering report justifies it. “H.” must state that the owner has to reestablish the nonconformity of the upgraded structure and that the structure will be regulated as a nonconforming building.
